When booking a shoot with B Snyman Photography you as the client agree and acknowledge the following:     

This contract is between B Snyman Photography (referred to as "photographer" or "the photographer") and the person who booked the photoshoot / paid for the photoshoot or who is receiving the photoshoot as gift (referred to as "the client / client"). If the person is a minor, a parent or legal guardian's assistance is required to enter these Terms and Conditions. These Terms and Conditions are also valid to the client’s guests and family during the photoshoot.    

The agreement will become effective once the booking is made and the 50% non-refundable booking fee is paid.     

Editing and Delivery:    

All photographs provided are edited AND NO natural / raw or unedited photographs will be provided.    

All edits and editing style are a direct representation of my work and unique to B Snyman Photography. The editing style is subject to the nature of the original photograph and no photograph looks identical therefore editing may differ, the photographer will provide edited photographs that the photographer believes is best fit for the photograph.    

When B Snyman Photography edits, all elements of the photograph are affected, the background, client's outfit and skin tones to an extent, therefore if the client has a significantly colourful outfit or a very distinguished colour, the colour may fade to a different shade of that colour and not look the same on the photograph as in person. B Snyman Photography selects all photographs that are edited and provided to the client, the client will not select the photographs that will be edited.  

There will be no cosmetic editing done on any individuals.     

Photographs will be provided within 30 days after the photoshoot date.    

Photographs will be provided to the client via a dropbox link provided to the client via email.    

Under no circumstances may the client edit over the photographer’s photographs, work or watermark.     

B Snyman Photography will not re-edit any photographs, if the client would request re-editing, there will be a fee charged of R10.00 per photograph re-edited once.   If by any chance, the delivered product from the photoshoot is unusable due to camera failure, SD failure or exposure difficulties, the photographer will not refund any payments made by the client, however the photographer will offer to reshoot at no additional cost (if there are travel fees required, this will be charged to the client).    

Copyright:    

B Snyman Photography is the sole owner of the photographs and therefore retains copyright of the photographs. B Snyman Photography has the right to use photographs on our social medias and website for advertising purposes. However, the client has printing and posting permission which allows the client to use the photographs for personal use and post them to their social media.    

Indoor Setting: 

Should the photoshoot be indoors or in a covered venue or location, the client realises that the lighting indoors is not always natural, which impacts the final photograph. 

If there is not sufficient lighting, the image quality will be impacted. 

For optimal utilisation of an indoor location, please provide that there is adequate natural light from windows either from the sides or front and avoid to have natural light from behind.  

Nature of Weather:    

Photographers are unable to control the weather therefore if there are unforeseen weather conditions such as rain, bad wind or thunderstorm, the photoshoot will be rescheduled.    

The client can select an indoor location for the shoot if the nature of weather does not allow to photograph outdoors. The client will not force the photographer to use their equipment in weather conditions that the photographer believes it is not safe to. If the photographer and the client cannot reach a date to agree on for the rescheduled photoshoot, the 50% booking fee will not be refunded.    

Injury:    

The client shall not hold the photographer responsible for any injury or harm that could be sustained during the client(s) photoshoot.     

Children:    

Children, toddlers and babies are fearful of strangers and objects such as a camera.    

Photographs with children are not always "picture perfect".    

The client is aware that booking a photoshoot with children, toddlers or babies can potentially result in photoshoot failure.     

Guest Co-Operation:   

The photographer is not responsible for the conduct of the client’s guests therefore the client must ensure that guests act in a manner that does not interfere with the photographer’s ability to photograph the guest’s or other subjects.    

Wardrobe, Make-up and Hair:    

The photographer is not liable for wardrobe, make-up or hair not matching surroundings or looking out of place in the photograph.     

The photography is not liable for wardrobe failure including but not limited to any underwear being visible in photographs.    

The photographer is not liable for unclear eyes while the client is wearing reflective or bifocal glasses.     

The photographer is not liable for make-up failure including but not limited to uneven tone, smudged make-up such as lip stick or mascara. The photographer is not liable for hair failure.     

Time, Additional Time & Location:    

The photographer and the client will meet at a pre-determined venue or location at a pre-determined time.    

The pre-determined time may not be changed once the booking is made and the non-refundable booking fee is paid.

During the shoot, additional time may be requested at an additional charge of R500 per 30 minutes. 

Additional Photographs: 

If the client seeks additional edited photographs above the amount included in the package, additional edited photographs can be purchased at a rate of R12 per photograph.  

Payment:    

A 50% non-refundable booking fee secures your booking.  

The balance of payment must be made 7 days prior to the photoshoot date. No photographs will be provided without full payment.    

Covid-19:    

If the client or the photographer tests positive for covid-19, the photoshoot can be rescheduled. If the client and photographer are unable to reschedule, the booking fee will not be refundable.    

If the event you have booked for gets cancelled, the booking fee will not be refunded but can be switched out to another type of shoot.     

Client Cancellation Policy:    

Should the client decide to cancel their shoot within 14 days from the photoshoot date, the 50% non-refundable booking fee will not be refunded.     

Should the client decide to cancel their shoot within 3 days from the photoshoot date, 75% of the shoot rate will be required (50% non-refundable booking fee + 25% payment for cancellation).
